End-User License Agreement & Terms of Use

All EqualInformation software, including Maker™ and Maker Pro™ · EqualInformation, LLC · Last updated 6 July 2026

Please read this Agreement carefully. It governs your use of the software products made available by EqualInformation, LLC (“EqualInformation,” “we,” “us,” or “our”) at equalinformation.com/tools — currently Maker™ and Maker Pro™ — together with related updates and services (the “Software”). By downloading, installing, accessing, purchasing, or using the Software, or by clicking “I agree,” you (“you” or the “User”) acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree, do not download, install, purchase, or use the Software.

Relationship to our general Terms of Service. For the Software, this Agreement controls. Any matter not addressed by this Agreement is governed by the EqualInformation Terms of Service, which also govern our mobile applications.

AI notice — read this first. Our software products are AI-powered tools. Software, code, text, and other outputs they produce are generated automatically and may be inaccurate, incomplete, insecure, biased, non-functional, or otherwise unsuitable for your purpose. You are solely responsible for reviewing, testing, and validating any output before relying on it, and for how you and others use anything you create with the Software. See Sections 6 and 9.

1.Definitions

“Software” means the software products made available by EqualInformation at equalinformation.com/tools, together with related updates and services, and includes all versions, releases, and prior builds of those products that remain available for download. Each product is either a “Free Product” (offered at no charge under an open-source license identified on its product page or in its source code, such as Maker, which is licensed under the MIT License) or a “Paid Product” (a proprietary product offered for a fee, such as Maker Pro). “Output” means any tool, code, file, text, or other material generated by, or with the assistance of, the Software. “Subscription” means a paid, recurring license to a Paid Product.

2.License grant

Free Products (including Maker) are licensed to you under the open-source license identified for that product — for Maker, the MIT License, the terms of which are included with its source code and control for that edition. Paid Products (including Maker Pro) are licensed, not sold. Subject to your compliance with this Agreement and, where applicable, an active Subscription or other required purchase, EqualInformation grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Paid Product for your own lawful purposes. You may not sublicense, resell, rent, or redistribute a Paid Product; remove or alter proprietary notices; circumvent licensing or activation; or reverse-engineer the proprietary components except to the extent this restriction is prohibited by applicable law.

3.Your content and Output; ownership

As between you and EqualInformation, you own the Output you create and are responsible for it. EqualInformation claims no ownership of your Output or your data. The Software itself, including all intellectual-property rights in the proprietary components of Paid Products, remains the exclusive property of EqualInformation and its licensors. Output may not be unique; the Software may generate similar Output for other users, and you are responsible for ensuring your use of Output does not infringe any third-party rights.

4.Local-first operation and privacy

Our software is designed to run locally on your device. Your prompts, files, and Output remain on your device except where you explicitly opt in to a feature that transmits data (for example, publishing a tool, cross-device sync, or connecting your own third-party AI account). Where you connect a third-party service through “Cloud Connect,” you do so under that provider’s terms and using your own credentials; EqualInformation neither controls nor is responsible for third-party services.

5.Subscriptions, billing, trial, and cancellation

  • Paid Products are offered on a recurring Subscription or other payment terms at the price shown on the product page at the time of purchase, and may include a free-trial period. Prices and features may change on prospective notice.
  • Payment is processed by our third-party payment processor (Stripe). By subscribing you also agree to the processor’s terms. You authorize recurring charges until you cancel.
  • You may cancel at any time through the customer portal; cancellation takes effect at the end of the then-current billing period. Except where required by law, fees are non-refundable and partial periods are not pro-rated.
  • If a Subscription lapses or is cancelled, the Paid Product’s features may be disabled, but any Free Product and any Output you already created remain available to you.

6.AI-generated Output — no reliance

The Software uses artificial intelligence, which can and does make mistakes. Output is provided for your convenience and may be inaccurate, incomplete, outdated, insecure, non-compliant, or unfit for any particular purpose. The Software may “hallucinate,” produce code with bugs or vulnerabilities, or generate content that is offensive, infringing, or unlawful if prompted or by chance. You must independently review, test, and verify all Output before relying on it, and you assume all risk arising from your use of Output. EqualInformation does not warrant, endorse, or take responsibility for any Output, and Output does not constitute legal, financial, medical, or other professional advice.

7.Acceptable use

You agree not to use the Software, or anything created with it, to: (a) violate any applicable law or regulation; (b) infringe or misappropriate any intellectual-property, privacy, or other right; (c) create or distribute malware, spam, or content that is harmful, harassing, defamatory, deceptive, or exploitative; (d) develop weapons, conduct surveillance, or facilitate activities that cause harm; or (e) attempt to defeat the Software’s licensing, security, or usage controls. You are solely responsible for the tools you build and for all use of them by you or anyone you make them available to.

8.Disclaimer of warranties

The Software and all Output are provided “as is” and “as available,” without warranty of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, EqualInformation and its owners, developers, contributors, and licensors disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement, and any warranty that the Software will be uninterrupted, error-free, secure, or that Output will be correct or reliable.

9.Limitation of liability

To the maximum extent permitted by law, neither EqualInformation, LLC nor its owners, developers, contributors, or licensors shall be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or relating to the Software, the Output, or this Agreement, whether based in contract, tort (including negligence), strict liability, or otherwise, even if advised of the possibility of such damages. In particular, neither the developers of the Software nor EqualInformation is responsible for anything you or any third party does using the Software or its Output, including any inappropriate, unlawful, or harmful use, or for any errors, defects, or omissions in AI-generated Output. To the extent liability cannot be wholly excluded, EqualInformation’s total aggregate liability shall not exceed the greater of (a) the amount you paid for the Software in the three (3) months preceding the claim, or (b) US$50.

10.Indemnification

You agree to defend, indemnify, and hold harmless EqualInformation, LLC and its owners, developers, contributors, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Software or any Output, (b) anything you create with or do using the Software, or (c) your violation of this Agreement or any applicable law or third-party right.

11.Third-party and open-source components

The Software includes open-source components (including the MIT-licensed Maker core) and may interoperate with third-party models and services. Those components are governed by their own licenses and terms, which continue to apply. EqualInformation makes no representation regarding, and is not responsible for, third-party components or services.

12.Termination

This Agreement is effective until terminated. It terminates automatically if you breach it. On termination you must stop using and delete the proprietary components of any Paid Product. Sections that by their nature should survive (including 3, 6, 8, 9, 10, and 13) survive termination.

13.Governing law and disputes

This Agreement is governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. The exclusive venue for any dispute shall be the state and federal courts located in Santa Clara County, California, and you consent to their jurisdiction. If any provision is held unenforceable, the remaining provisions remain in effect.

14.Changes to this Agreement; all versions

We may update this Agreement from time to time. Material changes take effect on the “Last updated” date shown above or as otherwise stated. Your continued use of the Software after an update constitutes acceptance of the revised Agreement.

This Agreement governs your use of every version of the Software, including older or previously released builds that remain available for download. Downloading, installing, or using any version of the Software constitutes your acceptance of the then-current Agreement, whether or not that particular build displays an in-app acceptance prompt. Newer versions may include security, signing, and licensing improvements, and we recommend using the latest.
